TEMPO.CO, Jakarta - The House of Representatives (DPR) Commission III has proposed including 13 types of crimes under Indonesia’s draft Asset Forfeiture Bill, ranging from corruption and drug offenses to human trafficking.
Commission III Chairperson Habiburokhman said the proposed offenses would be subject to asset forfeiture provisions under the bill.
He acknowledged concerns that ordinary citizens could have their assets seized even if they are not government officials. However, he stressed that Indonesia’s Constitution upholds equality before the law.
“Anyone who violates the law must face sanctions regardless of their position or background,” Habiburokhman said in Jakarta on Monday.
He said applying asset forfeiture to offenses beyond corruption was similar to practices in the United Kingdom, the United States and several other countries.
Habiburokhman also stressed that asset forfeiture must not be enforced arbitrarily against the public.
“The Asset Forfeiture Law must not become a tool of power to extort people, criminalize political opponents or silence those who are critical,” he said.
He said Commission III was therefore seeking the best formula to strengthen oversight of the implementation of the proposed law.
According to Habiburokhman, a strong institution would be needed to take action against law enforcement officials who abuse their authority in asset forfeiture cases. Such officials, he said, should face ethical, professional and criminal sanctions where applicable.
“In short, the implementation of the Asset Forfeiture Law requires clean and credible law enforcement officials,” he said.
13 Crimes Proposed for Asset Forfeiture
The following are the 13 categories of offenses proposed to fall under the asset forfeiture provisions:
Corruption
Drug and psychotropic offenses
Terrorism
Human smuggling
Illegal trafficking of weapons, ammunition and hazardous materials
Forestry-related offenses
Environmental offenses
Tax-related offenses
Banking-related offenses
Insurance-related offenses
Mining-related offenses
Maritime and fisheries-related offenses
Human trafficking
The proposed Asset Forfeiture Bill is intended to establish a legal framework for confiscating assets linked to criminal offenses. Habiburokhman said safeguards and oversight would be important to prevent the law from being misused.
He emphasized that the proposed framework should apply based on alleged violations of the law rather than a person's political position or status.
